1/ After a long wait, FinCEN has finally issued its new proposed rule extending AML regulation to non-custodial wallets.

It could've been worse (really), but it's still a terrible rule in both process & substance.

Here's what it says, what's wrong with it, & what we do next 👇

2/ The rule would impose new obligations on virtual asset service providers (VASPs) like exchanges & custodians.

For deposits & withdrawals > $3k involving a non-custodial wallet, VASPs would have to record the name & physical address of the wallet

3/ VASPs would also have to report any deposit or withdrawal > $10k to FinCEN in the form of a currency transaction report (CTR).

FinCEN says these requirements are necessary to "combat the financing of global terrorism," "address transnational money laundering...." You get it.

4/ Before now, the Travel Rule only imposed these record-keeping & reporting requirements on transactions from VASP-to-VASP.

Today's proposal follows a global trend of extending AML regulation to transactions from VASP-to-wallet, as we've seen from Switzerland, France, & others.

5/ Let's look on the bright side for a minute.

This doesn't require KYC for every transaction with a non-custodial wallet. It isn't an outright ban on self-custody. It doesn't prohibit the act of using a permissionless network.

It really -- REALLY -- could have been much worse.

The use of randomized controlled trials (RCTs) to study the impact of specific interventions, has over the last decade become a dominant methodology in development microeconomics

However, some argue that socioeconomic RCTs do not test hypothesis rooted in theory and ignore mechanisms of causality

For example,

"In 2006, approximately 1,300 men and women were tested for HIV. They were then offered financial incentives of random amounts ranging from zero to values worth approximately four month’s wages if they maintained their HIV status for approximately one year..."

"Throughout the year, respondents were asked about their sexual behavior three times, through interviewer-administered sexual diaries. Respondents were then tested for HIV, and financial incentives were awarded based on whether they had maintained their HIV status..."

"After the second round of testing, the incentives program stopped."

Today I made garlic bread.

You add flour, water, salt, and most importantly, yeast. When baking bread, you have to let the dough rise.

No reasonable intervention will significantly increase the speed the dough rises for really good bread, possibly the best bread in the world.

If you get the store bought stuff, it’s optimized for shelf life, which always detracts from the quality of the immediacy of the homemade stuff.

If you go to a bakery, it’s better, but never as good as the manual kneading you can do for yourself for what you want.

Bread making is simple, and world-class bread making is even simpler than what you may think. Mostly because humans converge on the flavors, texture, and content of their perfect bread.

But world-class bread does have shared constants of quality you can get only from the best.

Flavorless bread is bland. I’m a huge fan of personal choices I get with the categorization one has under the term “garlic bread.”

Shahjahanpur was a hub of revolution during the freedom struggle. Most of the revolutioaries in the North, were from this town. And among them, the most famous were two friends, whom destiny would bring together- Ram Prasad Bismil and Ashfaqullah Khan.

Ashfaqullah Khan was born at the turn of the 20th century on October 22, while Bismil was born 3 years earlier on June 11, in the same town. Both of them were excellent writers in Urdu and Hindi.

Both of them would come together under the Hindustan Republican Association, not to mention the fact that Ashfaq was an admirer of Bismil’s poetry, and became close friends with him on that account.

And both these men were hanged on the same date, December 19, 1927 for their involvement in the Kakori event. Two men from different religions, different backgrounds, yet destiny would bring them together.
