Lack of confidence in this year's election outcome is a real problem--steadfastly ignored by too many. I've said *state legislators* are appropriate body to address fraud w/in their borders. Here's the promised longer thread on fraud. /1 #ElectoralCollege

Disclaimer: I am not taking “fraud happened” or “fraud didn’t happen” side. I am answering those who've asked me how fraud can be addressed in #ElectoralCollege if/when it occurs. In an earlier thread I said congressmen are limited in what they can do. /2

As a foundational matter: I believe the problems started this summer when Governors began unilaterally changing election procedures, without legislative input. This was wrong. STATE LEGISLATURES are responsible for election laws. /3 #ElectoralCollege
This truth holds especially true in pres’l elections. #ElectoralCollege looks to *state legislatures* to be responsible for their states. The buck always stops w/ state legislators. Thus, 1st mistake made by too many legislators was a failure to push back on Govs this summer. /4
We have THREE branches of government. Why have we ignored #RuleofLaw all year? Why are Govs creating law when that’s the legislature’s job? How unsurprising that people distrust the election outcome after months & months of thumbing our noses @ Rule of Law. /5 #ElectoralCollege
The MSM had one job during month of November: Focus a spotlight on the states in question, allowing each & every claim to be fully vetted in public eye. Instead, MSM declared a winner & poked fun at voters who question the lack of transparency in elections. /6 #ElectoralCollege
#1 reason #ElectoralCollege protects agst fraud is bc of this spotlight that can be created, focused on problem areas. It's too hard to monitor every single precinct, nationwide, w/ this kind of intense scrutiny, but it's much easier to scrutinize handful of areas in this way. /7
This is what we did in Florida in 2000. Everyone had minute-by-minute updates on the recounts & lawsuits for weeks on end. It's what should have happened in AZ, NV, MI, WI, PA, & GA this year. /8 #ElectoralCollege
NO ONE should be confused as to what happened with some of the claims of observers getting kicked out, etc. Every American should know what happened & why. /9 #ElectoralCollege
Courts rightfully kicked out some claims & wd help if voters knew why. Also: some claims never fleshed out bc suits not heard for procedural reasons. How much better wd it be if MSM had hosted both GOP & Dem lawyers to explain things, case by case, every day? /10 #ElectoralCollege
Instead, Trump supporters watch their news channels where they never hear the Democratic side of the case. And Democrats watch their news channels where they never hear the concerns of Trump supporters. /11 #ElectoralCollege
State legislatures are the appropriate body to fix this terrible situation in which we find ourselves. It is their job to make sure their states are rightfully represented. It is their job to make sure elections are transparent. /12 #ElectoralCollege
Some state legislators are genuinely up a creek for now because they are not in session. I hope their first order of business when they meet in January will be to provide for automatic special sessions during #ElectoralCollege disputes. /13
I hope 2nd order of business will be to investigate claims that have been made very thoroughly & to fix voting systems. Even if they find that probs were minimal and/or not systemic, this thorough investigation absolutely must happen for voter confidence. /14 #ElectoralCollege
Voters: Your state legislators are accountable to YOU. If you don’t like how they're handling election, then pick up phone & call. Demand they go on record w/their thoughts about disputes in yr state. They can do this whether in session or not. /15 #ElectoralCollege
Too many of us fail to pay attention to races for local office. We need to pay more attention. If you don’t like what happened this year, then make your voices heard in 2022. I hope 2020 has taught us that we need trustworthy local officials, too. /16 #ElectoralCollege
One last thought about the #ElectoralCollege and fraud: While I think a brighter spotlight should have been shone on AZ, NV, MI, WI, PA, & GA this year, the structure of our system did give us enough of a spotlight to see the presence of potential problems. /17 #ElectoralCollege
But for the #ElectoralCollege, would we have any idea that there were potential problems in places like Detroit? I doubt it. We would have seen a 7 million vote margin and simply moved on. /18 #ElectoralCollege
If nothing else, the E.C. ensured that every American sees where the potential problems lie. We need to spend the next four years making things better. /19 & End #ElectoralCollege

More from Politics

This idea - that elections should translate into policy - is not wrong at all. But political science can help explain why it's not working this way. There are three main explanations: 1. mandates are constructed, not automatic, 2. party asymmetry, 3. partisan conpetition 1/

First, party/policy mandates from elections are far from self-executing in our system. Work on mandates from Dahl to Ellis and Kirk on the history of the mandate to mine on its role in post-Nixon politics, to Peterson Grossback and Stimson all emphasize that this link is... 2/

Created deliberately and isn't always persuasive. Others have to convinced that the election meant a particular thing for it to work in a legislative context. I theorized in the immediate period of after the 2020 election that this was part of why Repubs signed on to ...3/

Trump's demonstrably false fraud nonsense - it derailed an emerging mandate news cycle. Winners of elections get what they get - institutional control - but can't expect much beyond that unless the perception of an election mandate takes hold. And it didn't. 4/

Let's turn to the legislation element of this. There's just an asymmetry in terms of passing a relief bill. Republicans are presumably less motivated to get some kind of deal passed. Democrats are more likely to want to do *something.* 5/

Trump is gonna let the Mueller investigation end all on it's own. It's obvious. All the hysteria of the past 2 weeks about his supposed impending firing of Mueller was a distraction. He was never going to fire Mueller and he's not going to

Mueller's officially end his investigation all on his own and he's gonna say he found no evidence of Trump campaign/Russian collusion during the 2016 election.

Democrats & DNC Media are going to LITERALLY have nothing coherent to say in response to that.

Mueller's team was 100% partisan.

That's why it's brilliant. NOBODY will be able to claim this team of partisan Democrats didn't go the EXTRA 20 MILES looking for ANY evidence they could find of Trump campaign/Russian collusion during the 2016 election

They looked high.

They looked low.

They looked underneath every rock, behind every tree, into every bush.

And they found...NOTHING.

Those saying Mueller will file obstruction charges against Trump: laughable.

What documents did Trump tell the Mueller team it couldn't have? What witnesses were withheld and never interviewed?

THERE WEREN'T ANY.

Mueller got full 100% cooperation as the record will show.
