Commons debate of the Brexit deal kicks off in a bit and lasts until 2:30pm, when it goes off to the Lords. You can follow here.

I'm going to tweet along to the Commons bit because fuck it, what else is there to do. Just to eat and drink and be merry and relaxed, and why would anyone want to do something like that.

The great irony at the heart of it all. This entire process was done to give parliament control. In reality, it is spending much less time scrutinising constitutional changes than when we were in the EU.

As the transition period ends, the #BrexitDeal applies from tomorrow. But there's also a parallel significant legal change - most of the rest of the withdrawal agreement starts to apply. A thread on the legal issues in the rest of that agreement.

The citizens' rights provisions of the withdrawal agreement (on EU citizens who moved to the UK, and UK citizens who moved to the EU, before the end of the transition period) start to apply.

After today, UK citizens newly moving to the EU, or EU citizens newly moving to the UK, are in principle governed by national law (partly harmonised by the EU, on the EU side).

However, the #BrexitDeal contains some provisions on visas for service providers.

The #BrexitDeal also refers to the matching unilateral decisions of the EU and UK to waive a visa requirement for short tourist visits. Analysis of the EU law on that issue here:

UK citizens resident in the EU on the basis of the withdrawal agreement (or who move to EU in future) should be covered by the EU law on long-term resident non-EU citizens, which provides for a limited form of mobility between Member States. Analysis here:

On this, I think it’s highly unlikely to occur in the timeframe given. For several reasons, I don’t think it’s realistic for Scotland to secede, and then join the EU, in 9 years.

For that, thanks goes to Brexit.

Two important dates: March 2016 and January 1st 2021.

Firstly, prior to the 2014 referendum, the Nationalists proposed a date of March 2016 to secede.

Secondly, today - the end completion of Brexit five-and-a-half years after Cameron’s majority in 2015.

Brexit has demonstrated many things, primarily that splitting unions is not easy. The UKs membership of the EU was 47 years and by the end it was not at the heart of the EU. The Union has existed for over 300 as a unitary state.

Dividing a unitary state, like the UK, will not be easy. Frankly, it will make Brexit look simple. Questions of debt, currency, defence, and more will need to be resolved ... something not addressed with Brexit.

Starting with debt. Scotland will end up with its proportionate share of the UKs national debt. It’s not credible to suggest otherwise. Negotiating what is proportionate won’t be easy when both sides disagree.

It’s importance will be seen shortly.

I am in the market for positive, optimistic articles about Brexit - it may not be how I’m feeling but I’m sure I’ve missed things + want to avoid confirmation bias so I’m opening my mind, + this seemed like a good place to

Elliott argues that ‘the UK has deep, structural economic problems’ - true, but correlation is not causation: we look in vain for an argument that these problems are caused by EU membership and/or that membership is preventing them being tackled

The argument would be stronger if Elliott could show that other countries in the EU faced similar structural problems, but he doesn’t + I don’t think he could - the EU manages to incorporate a wide range of economic models, + regional inequalities vary hugely between EU countries

He does not attempt to acknowledge + explain the boom in inward investment in UK manufacturing in the last few decades, one of the few economic positives for ‘left behind areas’, though that may have been hard without referring to single market membership + European supply chains

‘Brexit means that those farmers who want their fruit harvested will now have to...pay higher wages or invest in new machinery.’ Maybe they will (but I’m not convinced) but this would have unintended consequences eg higher prices for healthy food

Scoop...Britain faces dearer electricity and occasional black-outs if it bans EU fishing boats from its waters after 2026. This de facto power over the UK power market is handed to the EU in the post-Brexit deal which MP’s will wave almost unread through parliament today. 1/10

The trade deal enshrines a link between continued EU access to British waters and UK frictionless access to the EU power grid and gas network. This has scarcely been noticed though it was mentioned and brushed aside by last night’s statement by the ultra-Brexiteer ERG. 2/10

The link – drawn to my attention by a senior EU source – is spelled out in dates, not words. The fisheries part of the deal grants EU boats continued access with a 25% cut in quotas over five and a half years until 30 June 2026. After that there are “annual negotiations” 3/10

The energy part of the agreement allows the UK virtually unchanged access to the continental electricity and gas markets. But that expires on exactly the same date as the fish deal - 30 June, 2026. After that (guess what?) there are “annual negotiations". 4/10

Coincidence? Not at all, my source says. The link is “more than implicit”. The energy deal “ends by default” unless both sides agree to extend it.
If the UK bans, or severely restricts, EU boats in British waters from June 30, 2026….easy access to EU energy will also end. 5/10

Been a lot of discussion recently around services trade in the deal between the UK and EU. Having read through the agreement over the past couple of days, my impressions👇

First off, services is definitely included. Question for service providers, is will it be enough?

My overall impression is that the EU has offered among the best in class for its FTAs similar to Canada and Japan.

But this access is a far cry from access to the Single Market and how is constructed as part of a trade agreement for the EU reflects that.

Unlike for goods trade, once you've got a product through all the customs and regulatory procedures into the EU, it can be sold anywhere in the EU, or its "entered circulation".

For services trade, that isn't the case. Its still done on a member state by member state level.

This is even true in the trade agreement itself where although the provisions set out in the Services and Investment chapter sounds awfully good - lots of principles about the freedom to establish and allowing the cross-border trade in services.

It's only when...

You get to the annexes and you realise both the EU and individual member states have put entry conditions across huge areas of different services sectors both now (existing measures) & in the future. Don't worry too much about the future reservations, it's the existing ones.

We were fed (excuse the pun) stories as late as November 2020 that #Brexit would lead to 60% reduction in haulage meaning 'months' of food shortages.

[3] Forget those foreign holidays unless you fancy swimming the Channel.

As late as October 2020 we were told that all flights would be grounded.

[4] In March 2020 as COVID hit Europe, we were told the only way to obtain ventilators was by joining the #EU scheme. We refused and Remainers screeched that the Government was putting Brexit over breathing.

I really can’t see how, after the last four and half years, the breakup of the UK can be avoided. What a historical irony that a Brexit intended to make Britain ‘great again’ actually brings about the demise of ‘Great’ Britain.

I actually don’t see this as a bad thing. After all, the aggressive chauvinistic nationalism, hubris, and exceptionalism that made Brexit possible is predominantly an English phenomenon. Part of the historical paradox whereby Englishness expresses itself through Britishness,

without explicitly recognising that this nationalism is primarily embedded in England rather than the Celtic periphery. A United Ireland is long overdue. Scotland - regardless of the debates about the economic viability of independence- has reached the point when a decisive

breach now seems inevitable. If this happens, Wales may well follow. Then, finally, England will have to decide what it wants to be, and look at the flaws and failings - political, economic, and constitutional - that it has put off dealing with, or blamed on others

Not arguing that Brexit was therefore a progressive development btw - far from it - but a country that was willing to do something so fundamentally harmful, and so stupid, and which allowed itself to be taken over by political forces of the kind we’ve seen, is an ill country

This very short article by Jeremy Cliffe is the best thing I have ever read on Brexit and the EU. It pivots on the contrast between Delors’ and Thatcher’s authentically provincial Christian visions and suggests the battle in Britain between the two is not over.

Thatcher: Protestant believer in the totally free market and absolutely sovereign centralised nation state. Delors: Catholic believer in third way personalism, corporatism and federalism. Individualism versus relational love. Heterodoxy versus Orthodoxy.

The article useful gives the lie to the idea that the Catholic vision of the EU has altogether vanished even though it is weakened. Delors wanted a social dimension to the free market and single currency and yet lexiteers laughably insist the EU is more neoliberal than the U.K.!

Subsidiary federalism is a doctrine of democracy and human fraternity. State sovereignty is a doctrine of naked power. It is a face of Antichrist. Leviathan.

Those combined that democracy can only be inside a single state fail to power just how much of private law and evermore so is necessarily international. Thus if political institutions don’t extend over borders there can be no democracy.
