2. One of the reasons *why* the Founders created a Supreme Court was to resolve interstate disputes (e.g., over borders, water rights, etc.).

Because lower courts might be biased, #SCOTUS was given "original" jurisdiction in such cases — allowing such suits to *start* there.

3. And today, in suits between states, #SCOTUS's original jurisdiction is *exclusive,* meaning that lower state and federal courts *lack* the power to hear disputes between two or more

4. But the Court has long understood "exclusive" to *not* mean "mandatory," even though some Justices (such as Justice Thomas) believe that it is.

Instead, states must seek "leave to file" an original bill of complaint, and such a motion is *not* granted as a matter of course.

5. One of the factors the Justices look to is whether the *issues* in the case can be resolved in other cases in the lower courts, even if not between the same parties. Thus, the Court usually denies leave unless it's a *uniquely* state-state dispute (again, like borders/water).

GOP witness conceded that he did not know whether a stack of 53 challenged ballots were received on time.

The board's witness testified they were.

Meanwhile in the Georgia case:

Sabrina German, the director of Chatham County's Voter Registration Office, backs up the prior witness's testimony that those 53 ballots were received on time.

None of them were double votes, she said.

Jeff Harris, from the Democratic Party of Georgia, notes both of the GOP witnesses conceded they had no idea about when those 53 ballots were received.

"They have been flatly incapable of proffering competent evidence to prove that point."

(PS) With Scotland going into lockdown, I don't know if this is a realistic option for Trump. But every major media report we've gotten for the last 2 months has said that Trump is almost *preternaturally* obsessed with losing his immunity from criminal prosecution on January 20.

(PS2) I've repeatedly said that—based upon my experience with 2,000+ criminal defendants—I don't believe that Trump would flee the country unless he believed he was facing imminent arrest (which, to be very clear, I don't think he believes). But this story is real and intriguing.

(PS3) The proper course of action now is for media to find out if Trump will be leaving the country at the moment that he loses his immunity from criminal prosecution. That is *also* the proper frame for the story—given what we know to be Trump's state of mind and preoccupations.

(PS4) The other, concurrent news story to at least keep in mind here is that Trump is in a legal dispute with his neighbors in Florida over whether he can reside at Mar-A-Lago. It gives him the perfect excuse to say that he needs to spend a few months at his property in Scotland.

Here are 10 questions I'm loosing sleep over regarding asylum at the border:

1) What process will the Biden administration put in place to help those who are already in MPP and have been waiting in danger in Mexico for a long time? Will it use parole for those with pending cases? What of those ordered removed and deported in abstentia?

2) Will the administration lift or change the CDC order so that asylum seekers can seek protection at the border?

3) If yes, will it rely on metering? Will it rely on swift screening that does not provide adequate due process? Will it shift away from detention?

4) There are many asylum seekers stranded in Mexico who were metered or expelled. Will there be any redress for them? Many of these folks are from Central America but many also from elsewhere--especially from Africa and Haiti (not subject to MPP).

5) How will the U.S. work with UNHCR, Mexico, local U.S. officials, and NGOs on both sides of the border to really make needed changes so that we turn the page on reception?

To my friends who supported Biden: Your candidate won. I and many others wanted a truly progressive candidate, but we were blunted by the efforts of the corporate rulers of this party.
