So strange that Law & Crime article questioning whether the Capitol rioters could be prosecuted for felony murder and it *never discusses* the most obvious predicate felony—burglary

As I will be teaching my first year criminal law students later this semester, felony murder is often a question of charging strategy for prosecutors. The defendant has often multiple felonies, some of which trigger felony murder and some of which don’t.

This article makes the classic mistake of analyzing only one possible underlying felony—sedition—and not the other, more mundane felonies, including burglary.
It’s the sort of error that loses students a lot of points on their final exam!

This basic error--misidentifying the relevant predicate felony--ends up affecting the other analysis in the article. For example, the author correctly points out that there are some other Qs that must be answered for felony murder to apply.

This analysis looks different if we are talking about burglary---which the Supreme Court defines not only as entering a building to commit a crime, but also remaining in the building.
That's going to make the "remoteness" inquiry pretty easy, not complicated as the article says.

The Alabama duo—Mo Brooks and Tommy Tuberville—is one I suspect the FBI will want to investigate. At all stages of the insurrection it seems Trump was working with two Alabama Republicans to ensure the insurrection and the opposition to Biden's certification worked hand-in-glove.

(PS) Mo Brooks was the first Republican to say he'd challenge Biden's certification; was at Trump's rally talking about "kicking ass"; was allegedly conspiring with Akbar. His Alabama GOP delegation peer, Tuberville, was Trump's Senate man, contacted by Giuliani mid-insurrection.

(PS2) A lot of people will be asking about conversations that may have occurred between/amongst Trump, Giuliani, Brooks, Biggs, Gosar, Tuberville, and Akbar as to how the insurrection would be timed and how it would dovetail with Brooks'/Tuberville's actions inside the Capitol.

(PS3) We now know both Trump and Giuliani contacted Tuberville as the insurrection was happening to get him to artificially elongate his objections to Biden's win. These exhortations would've had the effect—and appear to have been intended to—give the insurrectionists more time.

(PS4) I say "appear to have been intended to" because we now have numerous major-media reports establishing that Trump was "excited," "pleased," and "enthusiastic" as the insurrection unfolded. This was the same period of time he tried to *elongate* GOP objections to Biden's win.

Two Black officers told BuzzFeed News that THEIR CHIEF and other UPPER MANAGEMENT left them totally unprepared and were NOWHERE to be found on the day. Some fought them off for two hours before the attackers eventually gained access.

Many widely spread images of smiling marauders, wandering the halls dressed in absurd costumes, had the effect of downplaying how well prepared some of the rioters were to overtake the building & even capture & kill Congress members. Listen at 8 sec

I'm all for discussing Navaly's personal politics, and disagree with him on much, but saying the free world shouldn't stand up for someone jailed and nearly murdered because he's not Bernie Gandhi Mandela is bullshit. He's risking his life fighting a mafia dictatorship.

Plus, Navaly's politics as we know them (he's never held office), not coincidentally, largely reflect mainstream Russia, which is far from liberal by Western standards. This is probably a more useful topic anyway, tbh, esp re Crimea.

The narratives coming out of the "Storm the Capital" march are wildly insane. On all sides
1. @GOP @GOPLeader @senatemajldr @SenateGOP @JohnCornyn showed their colors. They betrayed us, again, as expected. We see all of them now.

2. Media, of course taking the Chyna money, has been more than happy to gleefully spin their demons upon us. An early victory lap. I had my run ins with them. Running into one, I said to one of the guys, "Look at that face diaper on her face! Showing off to her CCP masters?"

The Trump supporters who broke into the Capitol left behind shards of broken glass and ripped-apart furniture, blood, empty bottles, and even feces smeared on the walls.

The custodial staff cleaned up in places where people were bludgeoned & in one instance fatally shot, & where dozens of Capitol Police officers were wounded. "It felt bad. It's degrading," said a custodial employee in his 30s, who works for the Architect of the Capitol.

Several Capitol janitorial and labor employees — all of whom were Black or Latino — told Insider they no longer feel safe at their workplace, which is supposed to be one of the most secure in the country.

They recounted the hurt of cleaning up after white nationalists who could have threatened their lives, and they feared what's yet to come in the days leading to and on Inauguration Day.
