 👁‍🗨 Witnessing...they conclude that witnesses have to be "physically present" and you cannot witness somebody by video link. Probably correct as a matter of case law. It's a shame they aren't more forceful in their urge for change here...
The point in witnessing has always been evidential. So that if one person claims they didn't actually sign a document, you have somebody you can call upon to attest evidence that they did or did not. Also adds some formality to the process to make people think
When you're using e-signature, people's email addresses are being put into a system. You also have IP addresses, geolocations, timestamps all recorded when people actually go on to sign the document. Doesn't this add quite a lot of evidential value?
Physical presence would help avoid a scenario where somebody gains access to somebody else's email account, signs a document and then gets somebody to witness. If that witness were virtual, they wouldn't see the mischief that has occurred...is this not quite a remote risk though?
I'd love to have seen people go further and conclude that with e-signature platforms, witnessing is only really a secondary form of evidence and we should consider ditching the requirement altogether when e-signatures are used...probably issues there outside the commercial world

There still seems to be loads of people trying to encourage the use of QES and AES in commercial transactions because it increases security...personally I am completely against that, for two reasons...
First, in #biglaw transactions (different in other contexts perhaps, but am still doing research here), evidence has never been a problem. I've never come across a signatory who refutes that they signed a document...probably because law firms get client sign offs before release
Second, documents often require many many signatories, and documents are negotiated right down to the wire under huge time pressure. It's not always practical to wait until the document is final before sending through an e-signature platform...
...so most of the time, all people want is a way of *collating* signatures and running the signing *process* more efficiently, rather than having more evidential weight to solve a problem they don't believe exists...
Third, it's too much for people to get their heads around. Some jurisdictions require QES and AES. Whenever I have explained what this means and how to do it through a platform, they usually say "sounds too complicated, I'm just going to do pen and paper". I don't blame them.
✍️ Methods of signing. It is GREAT that the report talks about other ways of signing other than e-signature platforms. You might not actually need the powerhouse of an e-signature platform if you don't do signings that often
Too often I find people think e-signature = DocuSign = e-signature. That's not the case. There are other ways of doing e-signature, like using an iPad, using built in tools in PDF Readers etc. Those might do the job perfectly well.
🖇 Process. This was a great opportunity for the law society to lay out best practice when using e-signature platforms and answer the more practical questions. Most law firms have probably got their heads around the legal issues of e-signature by now...
What lawyers are crying out for is guidance on how to use the tools available...what kind of situations require an e-signature platform? can you date things through an e-signature platform?
...what if you need to make small amendments to the PDF afterwards, and corrupt the digital certificate? Does one law firm take control of the platform, or does everybody use individual platforms and combine into one afterwards? (etc).
These are the real questions that bother people, and a lack of answers to them leads to a lack of adoption of e-signature technology. And usually it's a "lowest common denominator" kind of issue, where it only takes one law firm in the process to raise a silly query...
Lots of room for improvement here and collaboration between law firms in terms of how they conduct signings and closings in practice...hopefully we will see a bit more of that to give comfort to the individuals who have to actually run signing processes on the ground...

In Virginia, armed men with rifles strapped to their backs have stood in the back of small hearing rooms inside the General Assembly, while our volunteers are in chairs in front of them, facing forward. They say it feels like the men could open fire on their backs at any moment.

The double wrist ties, tasers, discarded weapons all show an intention to go much further than they got


Seems so ordinary, becoming Lieutenant Commander Brock in the US Airforce ...yet the conversion from the ordinary into the extremist will make a fascinating study for psychologists @RichardBentall


His claim that he picked up the wrist ties “someone” had dropped so he could hand them into police is laughable.

And when you think about it rather cowardly. Can’t even take responsibility for what he has done.

Campaigner leading court action aiming to prove Scotland does not need WM’s blessing to hold an indyref has called on the Lord Advocate Jas Wolfe to say exactly who he represents, after a Court of Session judge yesterday described a motion as a “fishing diligence”.

Keatings:the most concerning aspect of the hearing was the refusal by Wolffe’s counsel to stipulate WHO the Lord Advocate is representing. “He was convened in this action to represent the interests of Scottish Parliament, NOT the Scottish Government."

Keatings: "We have a Lord Advocate (representing Scots parliament) being represented by ScotGov Legal Directorate (representing ScotGov), where Lord Advocate is supposed to be representing Scots Parliament but is advancing arguments on behalf of ScotGov, who have withdrawn!"

Keatings: “ScotGov seem to have dusted themselves in Lord Advocate coconut, & are trying to pass themselves off as a Scottish parliamentary snowball," antithetical to principle of separation of powers, as Lord Advocate spent more time wearing his “SG hat” than his parliament one

Mohammad Ghori, the young Ghurid Prince conquered Ghaznavids in Afghanistan in the year 1173 CE. He conducted some successful raids into the Indian territory, which even Mahmud Ghazni & the Persians couldn't do.


First&foremost,Ghori invaded states of Multan &Uch in India.After this he turned to southern states of Gujarat &Rajputana.Everybody knows this about Ghori,but what most pple r unaware of is the defeat he suffered at hands of Chalukyan Queen Naiki Devi in 1178 Battle of Kasahrada.


When he marched southwards, his first target was the prosperous fortified town of Anhilwara Patan.
It was the capital of Chalukyas(also known as Solankis of Gujarat) which was established by Vanraj of Chapotkata Dynasty in 8th century.


American historian Tertius Chandler states that it was the 10th largest city in the world at that time. The history of Chalukyas has been written by many historians, but the valour of the Great Queen Naiki Devi remains unsung.


Born to the Kadamba King Paramardin of Goa,Naiki Devi was well trained in sword fighting, horse riding, strategy & every other subject of Statesmanship. She was married to King Ajaypala of Gujarat who sat on throne in 1171CE. Unfortunately,the King died within 4 yrs of his rule.

Remember: Just because an idea is old doesn't mean it's good.

Knowing whether old ideas are more likely to be good requires understanding whether conditions have changed in important ways.

Horse archery was an amazing method of warfare for over a thousand years...then people invented guns, and suddenly this great idea that had stood the test of time became obsolete.

Then again, when underlying conditions don't change much, tried-and-true approaches are probably better.

"Learning the lessons of history" usually just means assuming ergodicity and stationarity in an informal time-series model...

Women have a fear that their man will leave them for someone younger & better-looking

We can conclude that men are attracted to looks, and women are attracted to status.

This is human nature down to its very core.

Crazy, blue-haired feminists will try to argue and say otherwise.

But, 50 years of feminism DOES NOT OVERRIDE millions of years of evolutionary biology.

The other strange thing that has started happening is pictures of Ram appearing sans Sita. “Jai Siya Ram” has become “Jai Shri Ram”. Some people disingenuously explain it as being the same thing - because Shri is a name of Lakshmi. Not really. Siya is an apbhransh of Sita. 4


Shri is a prefix of respect in this case. Hinduism is being militarised. A woman/Sita has no place in it. Even the militaristic Goddess that is Durga has no place in this conception of neo-Hindu divinity, as evidenced by Dilip Mandal wondering where Durga came from. 5

TYPES OF SINS(PAAP) AS PER SKAND PURAN.

There are three types of Adharma- Sthool, Sukshma and Ati Sukshma. The group of Sins in the Sthul section carries you to Narak. These sins are committed through your thoughts, words and deeds.


It is of four types.

1)First is the sin committed by your mental state-
Thinking about woman other then your spouse.

A)Resolution to amass wealth from others.

B)Thinking ill about others.

C)Thinking of doing a forbidden or unworthy deed.

2)Second is the sin that you commit through your words :-

A)Talking irrelevant things.

B)Telling a lie.

C)Speaking harshly.

D)Talking ill about others.

3)Third type of sin is committed through your body actions-

A)Eating food not prescribed to you or forbidden.

B)Violence.

C)Eating fancier food.

D)Acquiring other's wealth.

So these twelve types of sins.

There are six types of sinners or Mahapatak

1)One not bowing his head in front of a temple.

2)Never praise Shiva.

3)People who behave untowardly way in front of Ishwar.
