Delhi High Court is hearing a petition by Sr. Adv. Abhishek Manu Singhvi against the Central Board of Direct Taxes - filed in response to a penalty on Singhvi of about Rs. 57 crores, imposed for undisclosed income of almost Rs. 91 crores.

 Singhvi is making submissions on merits of the case.
Delhi High Court has asked Solicitor General Tushar Mehta to consider not taking any precipitative action against Singhvi.
Singhvi: Government has taken a lot of action to reduce tax related litigation. Singhvi refers to a scheme meant to reduce direct tax litigation taken out by the government.
Singhvi: I'm jumping out of sequence to refer to a CBDT Circular which repeats the same objects which were laid down in the Direct Tax Vivad Se Vishwas Act.
Singhvi: "Specified date" in the Act means Jan 1, 2020, which means they were adding some element of retroactivity as well in the legislation (up to 3 months).
Singhvi: The amazing part is that this Act requires entry only on 2 conditions: one, that there should be a pendency of writ, SLP or appeal, two, that it should be pending on a certain date. There is no other affirmative condition!
Singhvi: The provisions of this Act shall not apply in respect of tax arrears for a search case (search cases only above Rs. 5 crores).

Del HC: Does it include pendency before ITSC?
Singhvi: No, it doesn't include matters pending before ITSC.
Singhvi: One case I'm arguing is of search, within the Rs. 5 crore limit. The other case is of ITSC.
Singhvi: There is no model of the Act saying this nature of proceeding is included and this is not included.
Del HC: What is the amount being discussed here? Is it the amount before the ITSC or the one mentioned in this writ?
Singhvi: It is the amount in this writ. It does not exceed Rs. 5 crores.
Sr. Adv. Arvind Datar: The question is that when an Act has excluded certain things from its scheme, can a Circular subsequently add those things?
Court directs for the matter to be heard on Jan 12.

Solicitor General Tushar Mehta: I request for the matter to be held on Jan 13, as it doesn't concern a petition or petitioner, but would apply to the entire country.
Singhvi: My friend is trying to show that there would be an avalanche of matters but that is more imaginary than real.
Court: That is besides the point here for now.
SG Mehta: I'm not showing a red flag here, just telling that I'm not arguing against a particular petitioner here.

Singhvi: I am in agreement that whatever is decided would be the law.
The court has posted the matter for further hearing on Jan 12.

On a petition against the withdrawal ceiling of Rs. 5 lakh from deposits in the PMC Bank, @RBI submits yet again that the ceiling has already been raised from Rs. 1 lakh to Rs. 5 lakhs but allowing further withdrawals will result in "a run on the Bank."

The petitioner cites various instances of depositors in desperate need of funds suffering due to the withdrawal ceiling.

Chief Justice DN Patel had shown an inclination towards adjourning the matter, however, the petitioner is emphasizing his case through various factual instances.

CJ: If you raise these grounds, then everybody is in need of money. Nobody is saying that you don't have the need for the money. But please understand what the counsel for @RBI is saying, that if this is allowed, then many people may not get any money.

CJ: Somebody may have put their retirement money, someone may have put some other funds, but you are a counsel, and not a petitioner, kindly understand what the @RBI is pleading.

Supreme Court considers the suo moto case "IN RE: TO ISSUE CERTAIN GUIDELINES REGARDING INADEQUACIES AND DEFICIENCIES IN CRIMINAL TRIALS".

Sr Advs Siddharth Luthra and R Basant have submitted a draft rules on criminal practice.

The draft rules on criminal practice were submitted by the amicus curiae in March

Luthra : On March 5, 2020, a report on draft criminal rules was submitted after a colloquium with High Courts.

Luthra : After the draft rules have been circulated, we have only received responses of High Courts of Andhra Pradesh, Telangana, Allahabad and Delhi. As many as 20 High Courts have chosen not to respond.

CJI : We are thinking we will give High Courts to appear within 2 weeks. They may give suggestions to the draft rules or may accept the rules and give a statement regarding willingness to implement the rules in HC.

Most elite Indians (primarily savarna white collar urban english medium educated folks like me) land on Western shores convinced that we are just as advanced and developed as these countries as a people. It's just "corruption" in India holding us back. Then reality hits. /1

We see that the West works better on a daily level, but not because of some mythical genetic or societal immunity to this mythical "corruption" villain. Cos there is corruption in Western politics too. They seem to have institutions and systems built over ages to minimize it.

But most Indians who reach these shores are engineer/mba/doctor types. Trained in secondary vocational type disciplines. So our default approach is to find a quick engineering type solution. We have almost zero exposure to sociology, psychology, economics, anthropology, etc.

I remember being like that. Engineer-MBA who thought that because my vocabulary and exposition skills were above average and my quant skills were above average, I deserve a seat at the table on any discussion. Be it climate change, public health, efficacy of vaccines, etc.

For anything, I thought I knew the best. Why was this Obama fellow not trying my absolutely brilliant healthcare reform plan that I have posted on a blog with nice tables and graphs and references to IIT and IIM slang? Does he not know I'm from an IIM? <1% acceptance rate!

Recently, Harsimrat Kaur @HarsimratBadal_ claimed in parliament that Guru Tegh Bahadur protected the religion of Hindus despite of being a Non-Hindu. And Hindus owe a huge favor to others.

In this thread, I will show that Guru Tegh Bahadur was every inch a Hindu!

Let us begin with some contemporary sources.

Guru Tegh Bahadur visited the holy Triveni at Prayaga in 1662 CE.

This visit is documented in contemporary Bhat Vahi records.

Unlike those unpublished "bhat vahis", this one was published by Sikh historian Madanjit Kaur (1978)


This Bhat Vahi was signed by Guru Tegh Bahadur.

The content of the letter is particularly striking.

Guru Tegh Bahadur calls himself a devotee of Naina Devi.

Note. A devotee of Naina Devi. He does not mention Akal Purakh or Waheguru.


In the record, Guru Tegh Bahadur identifies himself as Sodhi Khatri by Varna and Kaushish by gotra.

This is exactly how the followers of orthodox Hinduism identify themselves to this date!


Further, Guru Tegh Bahadur appoints a brahmin purohit named Bhoj Raj.

He orders Sodhis of his line and all his Sikh followers to obey the aforementioned Brahmin Purohit.

This practice of appointing purohits is just what is referred to by some people as "Brahmanical Hinduism"

Devi ruled over Madurai and captured Indralok. She went on to capture Kailasha. When she saw Shiva, her 3rd breast disappeared and she realised that Shiva would be her consort.
The divine marriage was attended by all Devas and Sri Vishnu (as her brother) gave her hand to Shiva.


It is said that Indra found a swayambhu lingam at Kadamba Vanam. He placed it in Madurai where the kshetram stands. Here, Shiva is seen on the vehicle of Indra.
The Golden Lotus Tank is said to be the place where a golden lotus blossomed for the puja performed by Indra.


The Meenakshi Thirukalyanam festival is celebrated in the Chithirai month to mark the divine marriage of Meenakshi Amman. The festival includes a procession where Meenakshi and Sundareshwara travel in a chariot and Sri Vishnu gives away his sister in marriage to Shiva.

So the cryptocurrency industry has basically two products, one which is relatively benign and doesn't have product market fit, and one which is malignant and does. The industry has a weird superposition of understanding this fact and (strategically?) not understanding it.


The benign product is sovereign programmable money, which is historically a niche interest of folks with a relatively clustered set of beliefs about the state, the literary merit of Snow Crash, and the utility of gold to the modern economy.

This product has narrow appeal and, accordingly, is worth about as much as everything else on a 486 sitting in someone's basement is worth.

The other product is investment scams, which have approximately the best product market fit of anything produced by humans. In no age, in no country, in no city, at no level of sophistication do people consistently say "Actually I would prefer not to get money for nothing."

This product needs the exchanges like they need oxygen, because the value of it is directly tied to having payment rails to move real currency into the ecosystem and some jurisdictional and regulatory legerdemain to stay one step ahead of the banhammer.

A thing which I unironically and enthusiastically believe which is unpopular among smart people of my acquaintance: financial engineering has in the recent past and present contributed substantially to human welfare. We should hope to see more of it.

Maybe more geeks need to meet someone who says “My job is teleporting value across time and space.”

Financial engineering is sort of a squishy term. I don’t primarily mean payments infrastructure or financial rails, although both of those involve substantial engineering.

I mean more “We took a thing and performed some alchemy, and now have a new thing.”

Except instead of alchemy it is generally quite a bit of math, a huge amount of contract law and due diligence, often an impressive amount of ops work, and a dusting of technology that web devs would recognize as such.
