Thread: Absolutely not. The assertion that he will hurts our credibility and the cause because people who trust some accounts pushing it will be demoralized when it doesn’t happen. Let me explain:

2/ For this thread again, we will assume the Electoral Count Act of 1887 is Constitutional and binding. It very well may not be, but it doesn’t appear we have any court that will ever say so.

3/ The ECA is found in 3 USC 1-21. In secs 12 & 13, it requires that on the 4th Wed of Dec (that’s today) the President of the Senate (that’s Pence) to notify the states if he/she (or the Archivist) has not received a “certificate of vote and list” mentioned in sections 9 & 11.

4/ Sections 9 & 10 are merely administrative. Sec9 says that electors from the state make & sign six certificates of the votes w/ a lists for Pres & VP & attach a list of electors. Sec10 requires the electors to seal up the certificates & certify that the list of votes are inside

5/ The Pence Card is the idea that today, the VP can review & decide that the dem electors sent by AZ/NV/GA/PA/MI/WI don't meet the reqs of the ECA and/or the Const so, in effect, the VP hasn't received proper electors from the states & has a duty to notify them of that fact.

The House is now beginning two hours of debate on the article of impeachment charging President Trump with "incitement of insurrection."

Pelosi is the first speaker.

"He must go. He is a clear and present danger to the nation that we all love," Pelosi says. She says that removing Trump from office is "a constitutional remedy to make sure the republic is safe from this man."

Pelosi says the rioters "were not patriots," they were "domestic terrorists."

She asks House members, looking at the GOP side: "I ask you to search your souls and answer this question: is the president's war on democracy in keeping with the Constitution?"

Jim Jordan now says Democrats want to "cancel the president," one week to the day since insurrectionists attacked the Capitol.

He says Dems are "canceling the president and anyone who disagrees with them" - right after he said Liz Cheney should step down for voting to impeach.

GOP Rep. Tom McClintock is saying that all Trump did is give "a fiery speech to a group of partisans," and that most of the protesters on Wednesday were peaceful. He calls impeachment "petty, vindictive and gratuitous." His speech was met with scattered applause from Republicans.

How long until this the average Mar-a-Lago guest I wonder?

The Trump Org, like the White House, did have some good lawyers. They wouldn't touch these deals.

So, Trump brought in Michael Cohen--who is less of a lawyer than Rudy, Lin, Sidney, and Ellis--from a taxi dispatch office in Brooklyn.

The Pardon Clause prohibits using the pardon power to obstruct impeachments. Trump repeatedly opined—rightly—that Mueller's probe could lead to a referral for possible impeachment (which it did). The pardons he just gave are the ones he dangled to obstruct Mueller. See the issue?

Those who say the pardon power is unreviewable aren't just wrong, they *know* they're wrong. The Pardon Clause makes explicit that Congress has standing and a cause of action if the power is used to obstruct an impeachment. So the power is definitionally reviewable by the courts.

Moreover, if the grant of a pardon is itself a high crime or misdemeanor, it creates an irresolvable conflict between the Impeachment Clause and the Pardon Clause that only a federal court can resolve—making a pardon reviewable in that scenario too. That's the situation we're in.

Moreover, if a pardon constituting an abuse of power is issued so late in a presidential term it can't be remedied via the normal means—impeachment—it becomes impermissibly non-justiciable, and thus immediately reviewable by a court. That also happens to be the current situation.

Moreover, if a pardon constitutes the actus reus in an ongoing crime, the pardon itself can't pardon the ongoing crime—and therefore becomes legally inert and inoperative, as the pardoned party can still be prosecuted. That also happens to be the situation we're in right now.

Thread: Conservative Policy and the Trump Presidency

On the last full day of the Trump administration, I think it's useful to examine why he accomplished so little legislatively. TLDR version: American conservatism has almost no policy program.

The most important thing to know about conservative politicking is that people do not vote FOR Republicans, they vote AGAINST Democrats.

The GOP is dominated by a minority of far-right activists and wealthy donors who have views that their own voters don't support.

American conservatism is premised on the twin ideas that the New Deal & Great Society were immoral and that God himself created America and that we should honor this creation by establishing full Christian supremacism in which LGBT people, atheists, and Muslims have fewer rights.

Because God created America, this means that conservatives believe in essentially no domestic policy of any kind. If it wasn't literally in the Constitution, then the feds shouldn't be doing it is their opinion.

This is not, however, how things used to be in the GOP.

For much of its history, American conservatism was a sort of intellectual parasite on the Republican party which was run by a mix of moderates and liberals. They actually had domestic policies. Dwight Eisenhower and Richard Nixon had many policies that actually helped America.

THIS: It's a little late, but here is the final White House Coronavirus Task Force report from the Trump administration. It features some lessons learned from the federal officials on the panel, many that speak directly to the situation in

- Georgia is back to 6th in the country for new cases in the week leading up to 1.17 (not long ago we were doing better than nearly every other state)
- 5th in the country for test positivity
- 97 percent of all counties in the state in the "red zone"
