Earlier Marriage contract itself was the legal consent to sexual intercourse between the couple.

Respecting/Asking the will of the partner was no more than a " moral thing "

This is fairly starting to change since 90s as people now advocate that +++

"Consent for marriage Is not consent for S*x "

B ) Consent : It is asking the will of other partner before Indulging Into S*x

Before 40s : It was given In marriage contract .

Now : Modern Activists say it should be Acquired ( legally ) before S*x everytime.

C ) Rape :

The meaning of “rape” has also changed with the times, as it now means any forced sexual intercourse even within marriage. The reason for this change is that Western legal traditions shifted the basis of lawful sexual relations from contract to consent.

The marriage contract alone originally made " sexual relations lawful" , but now it is consent that legalizes sexual relations. This gave rise to the concept of [ marital rape ] and has influenced the legal discourse around the World .

Rape has always been meant something " Unlawful Intercourse " by force & against the will of person.

Ie the Issue of "marital rape" Isn't understood by most people . as It requires the original Defination of marriage & rape Itself to change !

Earlier the forceful Intercourse without consent of partner came under criminal law of "domestic sexual assault/wife harming" Ie it was conceived that a man has to harm her wife so as to have S*x against her will .

It was " harm principle " In place to punish the culprit .

Now It's not the "harm" that determines it but the lack of will . It was also easier to convict some of doing harm as it's clearly visible .

But with Marital r*pe , the discourse revolves around how to determine someone was willing or not.

Because it's a close-door matter +++

Betn two people ( No 3rd person eyewitness ) & that too Inherent to Individual's Inner desire/will . It's a very nuanced subject .

Nevertheless USA , UK & many western countries now has marital r*pe laws .
to prevent the women domestic abuse & abuse of her rights .

Some Muslim women bombarded a fellow Muslima with vile abuses last night for taking a jibe at the concept of "Con. to M is not Con. for S " .

Instead of explaining it's meaning & Importance .

Most people did it just coz others were doing it & to look "cool".
