Thread: The EU and AstraZeneca have agreed to publish the APA contract. Whilst the EU pushed for this they appear to have shot themselves in the foot.

 Clause 5.1 "AstraZeneca shall use its Best Reasonable Efforts to manufacture the Initial Doses within the EU for distribution...."

There are two features of this clause:

The first is It only requires Reasonable Best Efforts to manufacture. There is no guarantee of production.
The second is it only provides for access to vaccine manufactured within the EU. @vonderleyen's demand that @AstraZeneca should divert 75 million doses from the UK has no contractual basis.
The delivery schedule is literally named the "Estimated Delivery Schedule. There is no guarantee offered that it can be met. In fact it states it is for "earliest possible" delivery.
The @vonderleyen threats to sue @AstraZeneca are nothing more than bluster aimed at diverting attention away from the three month delay she and Merkel caused.

The EU need to calm the aggression, apologise to AstraZeneca. And allow them to continue to make reasonable best efforts for the earliest possible delivery of vaccine.
"AstraZeneca shall use its Best Reasonable Efforts to manufacture the Vaccine at manufacturing sites within the EU (which, for the purpose of this Section 5.4 only shall include the United Kingdom)" This would allow AstraZeneca to use production capacity in the UK.
But it does not allow for doses contracted to the UK to be diverted.
This ability to include the UK does not apply to clause 5.1 the supply of the Initial Doses which are of course the ones that will be later than the estimated schedule. I'm not sure if this is a drafting error but clause 5.4 only applies to 5.4. Perhaps it was meant apply to 5.
On reading again I get what they're trying to say. Including the UK only applies to manufacturing sites, it is not included in any other reference to the EU. Poor drafting IMO. So AZ could make best reasonable efforts to manufacture doses for the EU in the UK, even Initial Doses
This wouldn't oblige them to breach any existing contracts. I don't believe 13.1 e applies to the UK contract as this pre-existing contract does not impede the fulfilment of the order. In fact it has helped as AZ have ironed out production difficulties over many months in the UK.

The two most irritating sentences I find myself typing over and over on this website are:
1. "There are many pathways to universal healthcare"
&
2. "No, the Democratic party would not be a center right party in European countries either in social or economic terms"

& if you're going to come at me from the economic angle, plz do some research into EU center right parties. There's a lot of btwn-country variation, but these parties typically aim towards increased privatization of public systems & deregulation of industry. Dems do the opposite.

A related area is austerity. To look at recent history, examine how many EU countries chipped away at funding their extant safety nets, esp in healthcare, during the recession. What did the US do under Dems? A massive expansion of healthcare.

Now, the ACA is far from perfect and I want a much greater public role as well as the eventual minimization/near-elimination of private insurance in the system. That said, it's simply true that the U.S. expanded our healthcare system when many EU countries were cutting theirs.

You can't just compare a party in absolute economic terms across countries. This is especially the case when you have massive generational differences in building of the social safety net/welfare state.

So you’ll need to get a work permit for every country you’re intending to work or gig in and the rules are often different, as are the rules on eg taxation of that work (eg Spain has a withholding tax, France does not) 5/

After Michel Barnier's briefing of EU ambassadors this afternoon, here's where things stand:

2/ There is a basic deadline of Christmas Eve to get a deal. That will give the EU's legal services time to draw up a letter to send to the UK seeking provisional application of the treaty from Jan 1

3/ It's understood officials will need four days at a minimum to draft a letter seeking provisional application of the treaty (all this is on the basis that it is pretty much too late for the European Parliament to ratify the treaty on time for Jan 1)

4/ On the prospects for a deal: diplomats say they're not ruling out a deal by Christmas eve. Michel Barnier said there had been significant progress. Member states expect to convene a meeting of the Working Party (of Brexit coordinators) every day (except Christmas Day)

5/ Acc to one diplomat Barnier will publish the text once/if it's agreed, but before it's been legally scrubbed. Member states can approve the text via written procedure (sending a formal letter) as there are no Council meetings foreseen to do it in person between now and Dec 31

How significant were @vonderleyen's remarks to the European Parliament this morning?

One senior EU diplomat says takes note in particular of her opening words. "Frankly, I cannot tell you today if in the end there will be a deal."

5/ She repeated the demand for "robust mechanisms" to ensure competition is free and fair over time - ie, going back to the language of the Political Declaration. Also, the need "maintain common high standards now and in the future”. That's the "ratchet" or "evolution" clause

Every time the stock gives a breakout from the previous swing high add more position and go all-in.

I run two portfolios: Short term Swing and Long term Swing.

For Exit in Short term swings, I use a 2hourly Chart with super trend and RS. I am using @tradingview for the same.

For long term swing, I exit when the RS of the stock goes below 0. Period.
